This privacy notice details the policies used by Tara LaFerrara LLC, a Texas Limited Liability Company (“BROADS”, "we", "our", or "us") in collecting information from the BROADS mobile application (“Application”) and website (“Site”), and how the information and data are stored, used, shared and protected. We are committed to protecting your privacy and any personal information collected through this Site and Application.

Please read this Privacy Policy and the Terms of Use in their entirety before using this Site and Application. We are the controller for the personal information we process, unless specified below. Your continued use of any portion of the Application, Site, and any educational and informational content, training, instruction, or materials (“Services”) represents your consent to being bound by our Privacy Policy and Terms of Use.

  1. COLLECTING YOUR INFORMATION AND HOW IT IS USED

​When visiting the BROADS Application, our Site, or our social media channels, some personally identifiable information may be gathered at various points and may occur whether you have purchased a subscription and created an account (“Member Account”) to use the Application or Site, if you are using the Application or Site with a free trial, or if you cancel your subscription to the Application or Site but still have it installed on your device and still have an account created. This applies to personal data that we collect and not any information or data that is not considered personally identifiable or collected by any third party or website that you may be directed to access at any point within the Application or Site, by us or a third party.

  1. Information you choose to provide to us:

You may choose to create an account in the Application for use and grant certain permissions via your web browser or mobile device. The information collected from those fields is your name and email address, which will also be used for our mailing list, a username and password, credit card or banking information, billing address, date of birth, phone number, photographs uploaded, demographic information, and height. You are not obligated to provide your information to us through this Application or Site. Additional information may be collected if you choose to sign up for an ongoing subscription through the Application, which may also include your weight, goals, physical injuries, menstrual cycle, other exercise and health and fitness data, habits, tracking, goals, and information, and reviews and comments, depending on which membership level you sign up for. To access our membership services you will be required to log in using unique login credentials that you create. You may choose to submit information publicly throughout the Application or Site or privately via surveys, emails, or accessing support. If you choose to submit personal information publicly, that information can be collected and used by others. Some of this information may also be provided to the Memberful platform when you create a Member Account and may be collected, stored, and processed in accordance with their Privacy Policy and Terms of Service.

  1. Information collected from third parties:

If you create an account within the Application or use our Site, we may collect information about you from third parties. If you make any purchases, payment information provided by you at that time is stored through a third-party processor in accordance with their terms, and not on our Application or Site. Information provided by you to third parties may be transferred to us for us to perform services, track data, marketing, advertising, and maintain this Site or Application. We may use third-party services to obtain information about you for various purposes, including storing client files, connecting via a social networking site, marketing and advertising, and through an app store. When you use this Application or Site, you are agreeing not to hold us responsible for any security breach and/or for any unauthorized use of your personal information by third parties.

  1. Information automatically collected:

  1. Automatic Data Collection: We may at times automatically collect additional data for Application and Site analysis and other business purposes, including but not limited to using Google Analytics, as well as collecting information including your internet protocol (IP) address, mobile carrier, settings, general location information, time zone, internet service provider, pages you visit, links clicked on, content you interact with, your activity on the Application and Site, the date and time of access, other data collected from your device including through iOS or Android systems, and other information about your use of the Application and Site. We may also collect information from other analytics tools, marketing platforms, advertising networks, and third-party software development kits (“SDKs”), as well as any other related entity.

  2. Health Data Collection: We may collect personal information from an app connected to your device if you choose to provide it, including through the iOS Health app, Android help app, or others that may sync or connect with our Application or Site. Any health information that may be collected will be used in accordance with any required rules, regulations, and policies by those third-party apps and by law.

  3. Cookies and Other Tracking Technologies: Information on this Application, Site, or sent to you by email, including advertisements or other functions, may be processed using cookies, pixels, web beacons, server logs, local storage, SDKs, or other tracking technologies to automatically collect information (“Technologies”). A "cookie" is a small data file that may be placed on your hard drive or device by this Application or Site to assist with your use of this Application, Site, and our services and does not contain your personal identification information. These Technologies allow certain information to be stored for the next time you visit our Application or Site by remembering you; this may assist you with purchasing items from our Application or Site as well as with navigating your experience and can provide information to us on whether you have opened, acted on, or forwarded any emails or messages from us. These Technologies may also be used to track users' interests to help us improve, to assist with Site and App functionality, to interact with third-party services connected to the Application or Site, and gather information. You are not required to accept cookies to use our Application or Site, however, access to some information may be limited. Content placed on our Application or Site from third parties may also use these tracking Technologies, including cookies, to collect information from you when you are using the Application or Site. The collection and use of your information by third parties is not under our control. For additional information, you can contact the third parties for details on their policy, or opt-out or limit permission through the settings on your internet browser or mobile device.

  1. How Your Information Is Used:

  1. Your information may be used by us for the following purposes:

    1. To provide you with customer service, technical support and maintenance, requested information, or content.

    2. To provide access to the Application, Site, and the Services purchased, manage information, and manage Member Accounts.

    3. To communicate with you via email and or SMS or text messaging, including promotional information, newsletters, updates to our Site or Application, and other content.

    4. To create a personalized experience for the visitor of the Application or Site, including retaining purchase history to make suggestions for other services you may be interested in, retain and evaluate how you use and access different pages of our Application or Site for analytics purposes to improve, assist in improving Services or developing new services, Application or Site quality control and safety, and target advertisements based on previous interactions you have had on our Site and Application.

    5. To assist with creating de-identified or aggregated information including demographic or location information to assist with data analysis, marketing, and other business purposes.

    6. To assist with any fraud, security, or safety concerns or purposes.

    7. To enforce our rights under any contract created between you and us.

    8. To respond to any request made where we are obligated to by law.

    9. In managing our business activities, such as maintaining our records, providing services, marketing assistance, and other legal purposes.

    10. For any other purpose you consent to.

  2. Your information may be shared with third parties for various purposes including:

    1. If we send you a promotion regarding a third party and you choose to pursue that promotion or offer.

    2. Your information may be shared with our third-party marketing and/or advertising partners. These partners may set up Technologies or other tracking tools to collect additional information about your activities or device.

    3. For data and analytic purposes to perform the services we request of them only.

    4. For functionality purposes for the Site and Application, which may include Application Program Interfaces (“APIs”).

    5. Other service providers of ours who provide services to or on behalf of us.

    6. Our affiliates, subsidiaries, or affiliated entities.

    7. Social media and networking sites based on your interaction with us on our Site, Application, or online.

    8. Governmental or law enforcement authorities when required by law.

2. PROTECTING AND DISCLOSING YOUR INFORMATION

  1. Data Protection and Retention: We will store your collected information in a commercially reasonable method for as long as necessary for our business and in compliance with applicable laws. We do not intend to sell, share, or transfer your information to any third parties without providing you with notification, except for the following: to our affiliates and subsidiaries; service providers, and other third parties used for our business including payment processing, data analysis, operations, marketing, email delivery, hosting services, fraud prevention service providers, advertising partners, comply with legal obligations, and customer service; with your consent; to comply with any court order or lawful government request; if necessary to enforce our terms of use; in a sale or transfer of assets, merger or acquisition; or if we deem it necessary to protect our rights. We use commercially reasonable efforts to only share your data with third parties that post a privacy policy that meets all applicable laws, regulations, and requirements, including those required by Google and Apple.

  2. Security: We intend to keep all of the information that you add to the Application or our Site safe and confidential; however, given the nature of submitting information through the Internet by an unencrypted email, please do not submit any private or confidential information through email. We intend to keep any information you share protected; however, any data transmitted over the Internet cannot be guaranteed to always be and remain secure. Any information that you publicly share on our Site or Application may be used for any purpose. You are responsible for any personal information you choose to share, and it may be transferred to, processed, and storied in countries other than where you are located. When you use this Site and Application, you are agreeing not to hold us responsible for any security breach and/or for any unauthorized use of your personal information by us or by third parties.

3. YOUR PRIVACY RIGHTS

Based on the state in which you reside, you may have additional rights.

  1. These rights include:

    1. Withdraw your consent to the processing of your personal information; however, some functions of our Site or Application may not be available.

    2. Request to access, review, retain a copy, correct, or delete your personally identifiable information.

    3. Request data portability or receive an electronic copy of the personal information provided, specifically on personal information collected in the 12 months prior to your request.

    4. Request information on our disclosure of your personal information to third parties.

    5. Object to or restrict our processing of your personal information if it is non-compliant.

    6. Request to opt out of the sale of some of your personal information to third parties who sell or license your personal information to others.

4. OPTING OUT & CALIFORNIA DO NOT TRACK DISCLOSURES

  1. You may be able to opt out of some collection of information:

    1. To opt out of using cookies or other Technologies, you may change the permission through your internet browser or mobile device settings. This is not always possible on mobile devices, but you may be able to adjust settings for Android, iOS, or others. You may have to separately opt-out on each web browser and device.

    2. To opt out of having your information used through Google Analytics from our Site, you can opt out by installing the Google Analytics opt-out browser add-on here: https://tools.google.com/dlpage/gaoptout

    3. To opt out of email correspondence, please click the "unsubscribe" button at the bottom of our emails or see the section below.

    4. To opt out of any text or SMS messaging that you may agree to at any point, you may respond to unsubscribe based on the directions on how to do so in the text or message you receive.

    5. To opt out of notifications, you can limit or stop notifications you receive from us in your Account Settings within your Member Account on the Application or Site.

    6. To cancel your subscription and/or close your Member Account, you may use the settings in your account in the Application or email us a request.

  2. California Residents: For California residents: under CalOPPA and other laws you have certain additional rights:

    1. You may request to access, review, retain a copy, correct, or delete your personally identifiable information.

    2. You may request to withdraw your consent to the processing of your personally identifiable information; however, some features may no longer be available without it.

    3. You can also request information on our disclosure to third parties. If you wish to make a request please send a detailed email to info@broads.app.

    4. You may request from us once per year and free of charge, information on which third parties we have disclosed your personal information to, if any, for marketing purposes in the prior calendar year, and what type of personal information was disclosed. If you would like to make this request, please email info@broads.app

    5. If you wish to change your "Do Not Track" ("DNT") settings, this can usually be done by changing a setting on your internet browser or mobile device. There is no universally agreed-upon standard as to what should be done by site and app operators regarding these DNT signals, and as such, we may not respond to DNT settings. 5. CALIFORNIA CONSUMER PRIVACY ACT (“CCPA”)

If you are a California resident, you are afforded certain additional rights under the CCPA.

  1. These rights include:

    1. You have the right to know whether personal information is being collected about you, what that information is, and the purpose for that collection.

    2. You have the right to request the specific categories of information collected about you.

    3. You have the right to “say no” to the sale of personal information by opting out without any detrimental impact against you for exercising this right.

    4. You have the right to request the deletion of your personal data.

    5. You have the right to equal service and price, regardless of making any requests under these additional privacy rights.

6. EMAIL CORRESPONDENCE

We are committed to protecting your privacy, and this includes keeping your email address confidential. We do not sell, rent, or share our email subscription list. It is only disclosed to third parties in order to provide services to you. Our emails comply with the CAN-SPAM Act. An unsubscribe button is found at the bottom of every email from us. If you would like to unsubscribe from receiving future correspondence from us, please click on the link at the bottom of our email or email "unsubscribe" to info@broads.app.

7. GENERAL DATA PROTECTION REGULATION ("GDPR")

If the GDPR applies to you, you have certain data protection rights and are entitled to information. The GDPR applies to users in the European Economic Area ("EEA").

  1. These rights include:

    1. The right to request access to your personal data that we store, you may request copies of this.

    2. The right to rectification of any information you believe is inaccurate, or to complete the information you believe is incomplete.

    3. The right to object to how we process your personal data, under certain conditions.

    4. The right to request that we restrict the processing of your personal data, under certain conditions.

    5. The right to data portability, to request that we transfer the data we have collected to another organization or directly to you, under certain conditions.

    6. The right to request we erase your personal data, under certain conditions.

    7. The right to withdraw consent to our processing of your personal data, to the extent that we had relied on it to process your personal information.

    8. The right to lodge a complaint with a supervisory authority about our collection and use of your personal data. If you are an EEA resident, you can do this by contacting your local data protection regulator.

  2. The data processors used through this Site and Application each have their own privacy policy which can be found on their website. The data processors used include Amity, Memberful, Stripe, Google, and ConvertKit.

8. CHILDREN UNDER THE AGE OF 18

Our Application and Site are not intended to be used by children under the age of 18. We do not knowingly collect personal information from children under 18, or from any children who do not meet the minimum age requirement applicable in your jurisdiction. If you are under 18, do not use or provide any information on this Application or Site. If we become aware that we have collected or received personal information from a child under 18 without verification of parental consent, we will delete that information and take steps to remove it from the Application and Site and any servers or networks.

9. LINKS TO OTHER WEBSITES

This Application or Site may contain links to other websites. We are not responsible for the content or the privacy policies of websites to which it links, either by us or by any third-party member of the Application or visitor of our Site. Please review the privacy policies of those sites before use as we have no control over their collection policies.

10. CHANGES TO OUR PRIVACY POLICY

We reserve the right to change, alter, or modify this privacy policy at any time. Updates or changes to our policy will be posted on this page. Notice of any material changes to how we use, collect, protect, or disclose your information will be emailed to the email address provided by you when you created your account in the Application or Site, if applicable. The date our privacy policy was last updated is located at the top of this page. It is your responsibility as a user of the Application or Site to check for any changes in our policy and to provide us with an up-to-date and active email address.
